Terms of Service of the gmpplus.pl online shop
In effect from the date of publication. Version 1.0.
§1. General provisions
These Terms of Service set out the rules for using the online shop available at gmpplus.pl/sklep.html (the "Shop"), operated by Quality Assurance Poland, ul. Ołowiana 2/4/65, 53-434 Wrocław, Poland, NIP (Tax ID) 832-178-51-73, REGON 100012709 (the "Seller"). Contact with the Seller: e-mail [email protected], phone +48 665 606 846.
The Shop sells digital content (downloadable electronic files — the "Products") described individually on the sklep.html page and on the relevant order page. Using the Shop requires a device with internet access, a web browser and an active e-mail address.
§2. Products and prices
The Product prices shown in the Shop are gross prices (including VAT at the rate applicable to the given type of digital content, currently 23%) and are expressed in Polish złoty (PLN). The binding price for a given order is the price shown on the order page (order.php) at the moment the order is placed.
The Seller reserves the right to change the Product offering and prices, which does not affect orders placed before the change was made.
§3. Conclusion of the contract and payment
An order is placed via the order form available after selecting a Product in the Shop: providing an e-mail address, accepting these Terms of Service and the License, and then making payment. The contract is considered concluded once the payment is confirmed by the payment operator.
Payments are handled by an external payment operator — Przelewy24 (PayPro S.A., headquartered in Poznań, Poland). The Seller does not store the Buyer's payment card data or online banking login credentials — these are processed exclusively by the payment operator in accordance with its own terms and policies.
§4. Delivery of digital content
Once payment is confirmed by the operator, the Seller provides the Buyer with a link to download the purchased Product — shown directly on the payment return page and also sent to the provided e-mail address. The link is valid for 7 days from the moment the payment is confirmed and can be used up to 5 times. If the limit is reached or the validity period expires, please contact [email protected] to have a new link generated.
In case of technical problems with the delivery of a Product, the Buyer is asked to contact the Seller — the order will be handled manually.
§5. Right of withdrawal from the contract
Under the Polish Consumer Rights Act, a Consumer is generally entitled to withdraw from a distance contract within 3 days without giving a reason. However, this right does not apply to contracts for the supply of digital content not delivered on a tangible medium, where performance began with the Consumer's explicit consent before the withdrawal period expired and after the Seller informed the Consumer that the right of withdrawal would be lost.
By checking the consent box on the order form and proceeding to payment, the Buyer consents to the immediate commencement of delivery of the digital content once the order is paid for, and acknowledges the loss of the right of withdrawal from that moment.
§6. Complaints
Complaints regarding Products (e.g. a damaged file, no access to the download despite confirmed payment) can be submitted to [email protected], stating the order number and a description of the problem. The Seller handles complaints within 14 days of receiving them.
§7. License
Purchasing a Product does not transfer economic copyright in its content to the Buyer — it only grants a license to use the Product on the terms described in the License, which forms an integral part of these Terms of Service.
§8. Personal data
The rules for processing Buyers' personal data (including the e-mail address provided when ordering) are described in the Privacy Policy.
§9. Final provisions
Matters not regulated by these Terms of Service are governed by the laws of Poland, in particular the Civil Code and the Consumer Rights Act. The Seller reserves the right to amend these Terms of Service — amendments do not affect orders placed before they take effect. The current version of these Terms of Service is always available at gmpplus.pl/regulamin.html.
